TERMS AND CONDITIONS FOR ACCOMMODATION

Scope of Application

Article 1

  1. Accommodation Contracts and related agreements to be entered into between this Hotel and Guest to be accommodated shall be subject to these Terms and Conditions. Any particular not provided for herein shall be governed by relevant laws and regulations, and/or generally accepted practices.
  2. In the case where the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the provisions of the preceding Paragraph, the special contract shall take precedence over the provisions of these Terms and Conditions.

Applications for Accommodation Contract

Article 2

  1. A Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
    1. Name of the Guest;
    1. Date of accommodation and estimated time of arrival;
    2. Other particulars deemed necessary by the Hotel.
  2. In the case where the Guest requests, during her/his stay, an extension of the accommodation beyond the date(s) in subparagraph 2 of the preceding Paragraph, this shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Conclusion of Accommodation Contract and Related Agreement

Article 3

  1. An Accommodation Contract shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article. However, the same shall not apply when it has been proven that the Hotel has not accepted the application.
  2. When an Accommodation Contract has been concluded in accordance with the provisions of the preceding Paragraph, the Guest may be requested to pay as an accommodation deposit the selling price for the Guest’s entire period by the date specified by the Hotel.
  3. The deposit shall be first allotted for the selling price to be paid by the Guest, and when circumstances requiring application of the provisions of Article 6 and Article 19 have arisen, shall then be allotted to penalty and then to compensation money in said order, and the remainder, if any, shall be refunded at the time of the payment of the Accommodation Charges as stated in Article 12.
  4. If the Guest has failed to pay the deposit by the date specified by the Hotel as stipulated in Paragraph 2, the Hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the period of payment of the deposit is specified.

Special Contracts That Do Not Require an Accommodation Deposit

Article 4

  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract that does not require an accommodation deposit after the contract has been concluded as stipulated in the same Paragraph.
  2. In the case when the Hotel has not requested the payment of the deposit as stipulated in Paragraph 2 of the preceding Article nor has specified the date of the payment of the deposit at the time the application for an Accommodation Contract has been accepted, it shall be treated as being that the Hotel has accepted a special contract as prescribed in the preceding Paragraph.

Refusal to Accept Conclusion of Accommodation Contracts

Article 5

  1. The Hotel shall be at liberty not to accept the conclusion of an Accommodation Contract if any of the following arise:
    1. When the application for accommodation does not conform to the provisions of these Terms and Conditions;
    2. When the Hotel is fully booked and no room is available;
    3. When the Guest is deemed liable to conduct herself/himself in a manner that will contravene the law, or act against the public order or good morals in regard to her/his accommodation;
    4. When the Guest seeking accommodation falls under any of the following (a) to (c):
      1. When the Guest seeking accommodation is a member of an organized crime group, a member of a corporation/organization related to an organized crime group or an associate therewith or other antisocial forces (hereinafter referred to as “an organized crime group or other antisocial forces”);
      2. When the Guest seeking accommodation is a member of a corporation or other organization the business activities of which are under control of an organized crime group or a member of an organized crime group;
      3. When the Guest seeking accommodation is a member of a corporation that has officers who fall under the designation “member of an organized crime group;”
    5. When the behavior of the Guest seeking accommodation is likely to significantly disturb other guests;
    6. When the Guest seeking accommodation performs a violent act of demand of the Hotel or its staff (employees);
    7. When the Guest seeking accommodation can be clearly detected as carrying an infectious disease;
    8. When the Hotel is requested to assume an unreasonable burden in regard to the Guest’s accommodation;
    9. When the Hotel is unable to provide accommodation due to natural calamities, malfunction of the facilities or other unavoidable causes; and
    10. When any of the provisions of Article 5 of the Enforcement Ordinance of the Inns and Hotels Act issued by Tokyo is applicable to the Guest.

Right to Cancel Accommodation Contract by the Guest

Article 6

  1. The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
  2. In the case where the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case where the Hotel has requested payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has cancelled the Accommodation Contrast before payment), the Guest shall pay cancellation charges as listed in Attached Table No. 2. However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed of the obligation of the payment of the cancellation charges in case of cancellation by the Guest.
  3. In the case where the Guest does not arrive by 8 p.m. on the accommodation date (two hours after the expected time of arrival if the Hotel is notified of it) without advance notice, the Hotel may regard the Accommodation Contract as being cancelled by the Guest.

Right to Cancel Accommodation Contracts by the Hotel

Article 7

  1. The Hotel may cancel the Accommodation Contract under any of following cases:
    1. When the Guest is deemed liable to conduct and/or has conducted herself/himself in a manner that will contravene the law or act against the public order and good morals in regard to her/ his accommodation;
    2. When the Guest is considered to be corresponding to the following (a) to (c):
      1. When any of the Guests are members of an organized crime group or other antisocial force;
      2. When the Guest seeking accommodation is a member of a corporation or other organization the business activities of which are under control of an organized crime group or a member of an organized crime group;
      3. When the Guest seeking accommodation is a member of a corporation that has officers who fall under the designation “member of an organized crime group;”
    3. When the behavior of the Guest seeking accommodation is likely to significantly disturb other guests;
    4. When the Guest performs a violent act of demand or makes an unreasonable demand of the Hotel or its staff (employees);
    5. When the Guest can be clearly detected as carrying an infectious disease;
    6. When the Hotel is requested to assume an unreasonable burden in regard to the Guest’s accommodation;
    7. When the Hotel is unable to provide accommodation due to natural disasters or other force majeure events;
    8. When any of the provisions of Article 5 of the Enforcement Ordinance of the Inns and Hotels Act issued by Tokyo is applicable to the Guest; and
    9. When the Guest engages in prohibited actions such as smoking in bed, tampering with firefighting facilities or other acts prohibited under the Use Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to avoid the outbreak of fire.)
  2. In the case when the Hotel has cancelled the Accommodation Contract in accordance with the preceding Paragraph, the Hotel shall not be entitled to charge the Guest for any of the services in the future during the contractual period that the Guest has not received.

Registration of Accommodation

Article 8

  1. The Guest shall register the following particulars at the front desk of the Hotel or at an automatic check-in machine on the day of accommodation:
    1. Name, age, sex, address and occupation of the Guest(s);
    2. Except for Japanese, nationality, passport number, port and date of entry into Japan;
    3. Date and estimated time of departure; and
    4. Other particulars deemed necessary by the Hotel.
  2. In the case when the Guest intends to pay her/his Accommodation Charges prescribed in Article 12 by any means other than Japanese currency, such as traveler’s checks, coupons or credit cards, these instruments of payment shall be shown in advance at the time of the registration prescribed in the preceding Paragraph.

Occupancy Hours of Guest Rooms

Article 9

  1. The Guest is entitled to occupy the contracted guest room of the Hotel from 3 p.m. of the day of arrival to 10 a.m. the next morning. However, in the case when the Guest is accommodated continuously, the Guest may occupy it all day long, except for the day of arrival and departure.
  2. The Hotel may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the room beyond the time prescribed in the same Paragraph. In this case, extra charges shall be paid as follows:
    1. Up to 3 p.m.: half of the room charge, and
    2. After 3 p.m.: room charge in full.

Observance of Use Regulations

Article 10

  1. The Guest shall observe the Use Regulation established by the Hotel that are posted within the premises of the Hotel.

Business Hours

Article 11

  1. The business hours of the main facilities, etc. of the Hotel are as follows, and those of other facilities, etc. shall be notified in detail in provided brochures, and in displays in each place inside the Hotel and the service directory provided in guest rooms and other places.
    1. Closing time of main entrance: None
    1. Front service/cashier’s desk: Limited
    2. Service hours at facilities: Please refer to the Hotel Information

Payment of Accommodation Charges

Article 12

  1. The breakdown of the Accommodation Charges, etc. that the Guest shall pay is as listed in Attached Table No. 1.
  2. Accommodation Charges, etc. as stated in the preceding Paragraph shall be paid in Japanese currency or by means other than Japanese currency such as traveler’s checks, coupons or credit cards recognized by the Hotel at the front desk or at an automatic check-in machine at the time of the arrival of the Guest or upon request by the Hotel.
  3. Accommodation Charges shall be paid even if the Guest voluntarily does not utilize the guest rooms once such rooms have been made available to the Guest by the Hotel.

Liabilities of the Hotel

Article 13

  1. The Hotel shall compensate the Guest for any damage if the Hotel has caused such damage to the Guest in the fulfillment or the non-fulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in the case where such damage has been caused due to reasons for which the Hotel is not liable.
  2. The Hotel has received a certificate of compliance with firefighting laws and regulations issued by a fire station; however, the Hotel is covered by a Hotel Liability Insurance in order to deal with unexpected fires and/or other disasters.

Handling When Unable to Provide Contracted Rooms

Article 14

  1. The Hotel shall, when unable to provide contracted room(s), arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest.
  2. When arrangement of other accommodation cannot be made notwithstanding the provisions of preceding Paragraph, the Hotel shall pay the Guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to the reparation. However, when the Hotel cannot provide accommodations due to causes for which the Hotel is not liable, the Hotel will not pay the compensation fee to the Guest.

Handling of Deposited Articles

Article 15

  1. The Hotel shall compensate the Guest for the damage when losses, breakages or other damages are caused to goods, cash or valuables deposited at the front desk by the Guest, except in the case when this has occurred due to causes of force majeure. However, with respect to cash and valuables for which the kind and values have not been reported by the Guest, the Hotel shall compensate the Guest within the limit of 100,000 yen.
  2. The Hotel shall compensate the Guest for the damage when losses, breakages or other damages are caused, through intention or significant negligence on the part of the Hotel, to goods, cash or valuables that are brought into the premises of the Hotel by the Guest, but are not deposited at the front desk. However, for articles of which the kind and value have not been reported in advance by the Guest, the Hotel shall compensate the Guest within the limit of 50,000 yen.

Custody of Baggage and/or Belongings of the Guest

Article 16

  1. When the baggage of the Guest is delivered to the Hotel prior to her/his arrival, the Hotel shall be liable to keep it only when the Hotel has agreed to do so. The baggage shall be handed over to the Guest at the front desk at the time of her/his check-in.
  2. When baggage or belongings of the Guest are found after the Guest has checked out, the Hotel shall keep the items for a maximum period of seven days including the day on which they were found, and after this period the Hotel shall dispose of the items in accordance with the Lost Property Act.
  3. The Hotel’s liability in regard to the custody of the Guest’s baggage and belongings with respect to the preceding two Paragraphs shall be assumed in accordance with the provisions of Paragraph 1 of the preceding article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the preceding Paragraph.

Cleaning of Guest Room

Article 17

  1. When the Guest stays in the same room for two or more consecutive nights, the room will, in principle, be cleaned every day.
  2. Even if the Guest expresses it is not necessary to clean the room, the room will be cleaned once every three days for maintenance of healthy environment. However, when the Hotel deems it necessary, the Hotel is permitted to clean the room from time to time.
  3. The Guest may not refuse the cleaning of the room referred to in the preceding Paragraph.

Liability in Regard to Parking

Article 18

  1. As the parking lot of the Hotel is managed and operated by a third party, the Hotel shall not be liable for the management of the parking lot and the vehicle of the Guest when the Guest utilizes the parking lot within the premises of the Hotel, regardless of whether the key to the vehicle has been deposited with the Hotel or not.

Liability of the Guest

Article 19

  1. The Guest shall compensate the Hotel for any damage caused through intention or negligence on the part of the Guest

Handling of Personal Information

Article 20

  1. The Hotel will handle the Guest’s personal information in compliance with the Personal Information Protection Policy prescribed separately and in accordance with applicable laws and regulations. In principle, the Hotel will not disclose personal information provided by the Guest to any third party without the consent of the Guest. However, the Guest’s personal information may be disclosed to third parties in the following circumstances:
    1. Formal inquiry on a legal basis by police authorities, courts or other official institution; or
    2. Other serious and urgent necessity of the Guest, the Hotel or a third party.

(Remarks)

  1. The percentage signifies the rate of cancellation charge to the selling price (room charge).
  2. If there are any selling price regulations provided separately such as an accommodation plan, said regulations will prevail.
  3. When the number of days contracted is shortened, the cancellation charge for one day (the first day) shall be paid by the Guest regardless of the number of days shortened.
  4. When part of a group booking (for 15 persons or more) is cancelled, the cancellation charges shall not be charged for the number of persons equivalent to 10% of the number of persons booked as of 14 days prior to the occupancy (when accepted less than 14 days prior to the occupancy, as of the date) with fractions counted as a whole number.

Facility Use Regulations

To ensure the safety and comfort of all guests, we have established the following regulations governing the use of our facilities. Each guest is requested to observe and comply with the following regulations.

1. Scope of Application

These regulations will apply to all visitors who use any of the facilities of the Hotel (including all facilities such as accommodations, cloakrooms, lobbies and Hotel sites; hereinafter referred to as “Hotel Facilities”). Any matter that is not provided for in these regulations will be governed by the Terms and Conditions for Accommodation.

2. Fire Prevention and Security

  1. NO SMOKING WITHIN THE HOTEL FACILITIES. Please refrain from smoking outside the smoking section designated by the Hotel.
  2. Please do not enter backyards, emergency stairwells, machine rooms or restricted areas except for those into which the Guest is permitted to enter.

3. Handling of Articles Left in the Hotel and Forgotten Articles

  1. In principle, the Hotel shall keep the articles left in the Hotel for a period of seven days including the day on which they were left behind, and after this period the Hotel shall dispose of same.
  2. Forgotten or lost articles will be handled in accordance with relevant laws and regulations.

4. Prohibition of Use of Facilities by Antisocial Forces

  1. The Hotel will refuse the use of the Hotel Facilities by any of the following organizations or individuals:
    1. An organized crime group, a member of an organized crime group, an organization related to an organized crime group or an associate therewith;
    2. An associate with a corporation or other organization, the business activities of which are under control of an organized crime group or a member of an organized crime group;
    3. An antisocial organization, a member of an antisocial organization or an associate therewith;
    4. An individual who is deemed to have conducted acts of violence, injury, threat, or made overbearing undue claims or similar acts;
    5. An individual who is incapable of securing herself/himself due to diminished capacity, or loss of control due to substance abusing, etc., or who may cause danger, fear or anxiety to other guests; and
    6. An individual who failed to immediately stop the act upon being reprimanded by the Hotel in regard to the following Article 5 “Other Prohibited Matters.”
  2. If an organization or individual is considered to fall under any of the items referred to in the preceding Paragraph, the Hotel will refuse all use of the Hotel Facilities from the time when such consideration is made.

5. Other Prohibited Matters

  1. To disturb other guests such as by shouting, singing loudly or making loud noises in the Hotel Facilities.
  2. To bring the following items that may cause trouble to other guests into the Hotel Facilities:
    1. Animals such as dogs, cats or small birds, or other pets (except guide or service dogs for physically challenged persons);
    2. Ignitable or inflammable powder, gasoline or other oil, dangerous items, items with offensive odors, items of great bulk and other items that are prohibited to own under local laws and regulations.
  3. To engage in gambling, or otherwise corrupt public morals or disturb the peace in the Hotel Facilities.
  4. To distribute any advertisements or promotional items or to sell or offer for sale any items in the Hotel Facilities without obtaining permission from the Hotel.
  5. To distribute leaflets, etc. or engage in a signature campaign, etc. in the Hotel Facilities without obtaining permission from the Hotel.
  6. To leave any personal belonging in the hallway or lobby.
  7. To damage, deface or lose any fixtures or fittings or facilities or other articles of the Hotel due to reasons other than force majeure events, in which case, the Hotel may claim compensation for the damages in an equal amount. If the Guest smokes in the guest room, the Hotel will charge the Guest 30,000 yen as a penalty.
  8. To step outside of guest rooms while wearing hotel nightwear or slippers, etc.
  9. To engage in other acts that the Hotel deems inappropriate.
